The project focuses on a systematic study of civil liability under Article 82 of the General Data Protection Regulation. Through a comparative legal analysis of the legal systems of the European Union Member States, the project critically examines legal concepts, procedural issues in establishing liability and determining compensation amounts, as well as the development of case law related to compensation for violations of the right to personal data protection. The central outcome of the project is the creation of a comprehensive website that will bring together relevant scientific findings and case law from Croatian and foreign courts, as well as the Court of Justice of the European Union. This unique resource will enable injured parties to better understand their legal position and realistically assess their prospects of success in potential legal disputes. At the same time, data controllers and processors will be able to more clearly consider the basis of their liability and adjust their operations in accordance with legal requirements, while lawyers and judges will gain a valuable tool for more effective preparation and conduct of compensation proceedings.

Project goals:

• Strengthening the Project Manager’s research competencies for conducting internationally relevant and innovative scientific research related to civil liability for damage caused by violations of the General Data Protection Regulation, as well as enhancing his scientific excellence;
• Conducting socially significant and sustainable scientific research in the field of the General Data Protection Regulation, contributing to the availability and transparency of research results in accordance with the principles of open science, with the aim of ensuring the lasting and sustainable application of those results;
• Creating a sustainable website that will digitally integrate scientific knowledge and recent case law on liability for damage caused by violations of the right to personal data protection, thereby benefiting all relevant stakeholders in the field;
• Improving the quality of international scientific and professional cooperation of the Project Manager.

Expected results:

• Throughout all the years of the project’s duration, relevant scientific and professional literature related to liability for damage caused by violations of the right to personal data protection will be collected. By participating in scientific conferences, the Project Manager will establish enhanced scientific and professional cooperation with relevant international stakeholders in the project’s field and will conduct a comparative legal analysis of the subject matter during research stays at foreign universities and research institutes. Furthermore, an international scientific conference open to the public will be organized, and a book of abstracts from the conference will be published. The Project Manager will prepare three scientific papers for publication in reputable international or domestic scientific journals. During the project, a website will be developed to bring together scientific knowledge and relevant case law on liability for damage caused by violations of the right to personal data protection. Finally, in the last year of the project, a domestic scientific conference open to the public will be organized, and a book of abstracts from that conference will be published.
